Terms and Conditions

1. Acceptance and operator

Quest & Keep is a project published by Gato Chico Publishing. By accessing the website, creating an account, or using a member feature, you agree to these Terms and Conditions and acknowledge our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be legally able to enter into these terms where you live. If you are not, a parent or legal guardian must authorize and supervise your use. You must provide accurate information, keep your account secure, and promptly tell us about suspected unauthorized access.

You may sign in with Google or a secure email link. Your use of Google is also subject to Google's terms. You may not impersonate another person, create accounts by automated means, or transfer an account without our permission.

3. The Quest & Keep service

Quest & Keep supports a series of physical adventure journals. The website may provide public bonus quests, book and quest unlocking through eligible QR codes, XP tracking, a private photo repository, account features, newsletters, and links to third-party sellers.

Features may differ by book, language, region, or release phase. Buying a physical book does not guarantee that every digital feature will remain available forever, but we will use reasonable care when changing material features.

4. QR claims, quests, and XP

Eligible QR codes may unlock a book or quest and award the stated base XP once per quest and account. Additional XP may depend on completing available actions. QR access and XP are personal, promotional features associated with Quest & Keep; they are not money, property, a security, or a transferable balance and have no cash value.

You may not automate claims, manipulate QR links, exploit errors, share private claim credentials commercially, or falsify completion. We may reject, reverse, or correct claims and XP affected by duplication, error, fraud, or abuse, and may update balancing rules prospectively.

5. Your photos and other content

You retain ownership of photos and other content you upload. You grant Quest & Keep a limited, non-exclusive, worldwide license to host, copy, resize, convert, secure, back up, and display that content back to you only as needed to operate and improve the feature. This license ends when the content is deleted from active systems, subject to reasonable backup and legal retention.

You confirm that you have the rights and permissions needed for anything you upload, including permission from identifiable people where required. Do not upload illegal, infringing, abusive, exploitative, dangerous, malicious, or privacy-invasive content. Quest photos are private by default and are not licensed for our marketing without separate express permission.

6. Acceptable use

You may use Quest & Keep only for lawful, personal purposes and in accordance with these terms.

• Do not disrupt, overload, probe, reverse engineer, or bypass security or access controls.
• Do not scrape private content, introduce malware, automate abusive traffic, or misuse another person's account or data.
• Do not copy or distribute protected book or website content beyond uses allowed by law or our written permission.
• Do not use the service to harass, harm, deceive, or violate another person's rights.

7. Newsletter and service communications

A Quest & Keep account does not automatically subscribe you to marketing. Newsletter enrollment requires a separate choice and email confirmation, and you may unsubscribe at any time. We may still send essential account, authentication, security, or service messages when necessary to provide the features you use.

8. Quest & Keep intellectual property

Except for content you upload, the website, books, quests, artwork, branding, text, software, layouts, and related materials are owned by Quest & Keep, Gato Chico Publishing, or their licensors and are protected by intellectual-property laws. These terms give you a limited, revocable, non-transferable right to use the service for its intended personal purpose; they do not transfer ownership.

9. Third-party services and purchases

Quest & Keep relies on third-party services, including Google sign-in, hosting, storage, database, and email providers. Links to retailers or other websites are provided for convenience. Their availability, content, purchases, shipping, returns, security, and privacy practices are governed by their own terms, and Quest & Keep is not the seller unless expressly stated at checkout.

10. Adventure safety

Quests are invitations for reflection and everyday adventure, not professional medical, legal, fitness, animal-care, or safety advice. Use judgment, follow local rules, respect people, animals, property, and nature, and choose activities appropriate for your health, abilities, companions, location, and conditions. Never place yourself or anyone else at risk to complete a quest or earn XP.

11. Availability, changes, and termination

We may maintain, modify, suspend, or discontinue features to improve the service, address security or abuse, comply with law, or manage operations. When practical, we will provide reasonable notice of material changes that negatively affect users.

You may stop using the service at any time and may request account deletion at hello@questandkeep.com. We may restrict or terminate access for a material or repeated breach, fraud, security risk, or legal requirement. Sections that by their nature should survive termination will remain effective.

12. Disclaimers and liability

To the extent permitted by applicable law, the service is provided on an “as available” basis. We do not promise uninterrupted or error-free operation, permanent availability of a specific quest, or compatibility with every device. Nothing in these terms excludes warranties or consumer rights that cannot lawfully be excluded.

To the extent permitted by law, Quest & Keep and Gato Chico Publishing are not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the service. Any liability that cannot be excluded remains limited only to the extent the law permits. These limitations do not apply where prohibited or to liability that cannot lawfully be limited.

13. Applicable law and disputes

These terms are governed by applicable law, including any mandatory consumer protections where you live. Please contact hello@questandkeep.com first so we can try to resolve a concern informally. Any unresolved dispute will be handled by the competent courts or authorities determined under applicable law.

14. Changes and contact

We may update these terms as the service changes. We will post the new effective date and provide additional notice before material changes take effect when required. Continued use after the effective date means you accept the revised terms, except where law requires a different form of consent.
